Our Alabama Family Law Practice Areas
Our attorneys can represent you if you are involved in a family legal matter. Our family law practice areas include:
- Divorce. Filing for a divorce is extremely sensitive, and a decision that no one comes to easily. If you are pursuing a divorce or separation from your spouse, our lawyers can assist you with divorce planning, filing for the divorce, negotiating various elements of the divorce such as a property division and spousal maintenance, gathering evidence to support your case, and more. If your divorce goes to trial, our lawyers will aggressively represent you in court.
- Child custody and child support. Whether you are married or not, if you are a parent who is not living with your child’s other parent, then child custody and support are legal issues you will no doubt have to face. Child support and child custody can be extremely contentious and can be difficult for even the most compromising of people to agree upon. As you work with your child’s other parent to create a parenting plan, our lawyers can advise you of the law and your options, represent you during mediation, and advocate for your interests.
- Pre- and post-marital agreements. When a couple first marries, the thought of not being together in the future is never on the mind. But unfortunately, the future is unpredictable and in some cases a couple may be separated by death or divorce. Planning for these events–even if they never happen–is wise. Our lawyers can assist you and your soon-to-be spouse in crafting a premarital agreement that addresses how property will be divided in the event of a divorce or death, how children will be provided for, the protection of a family business or heirlooms, protection against the other party’s debts, and more.
- Domestic violence protective orders. Some of the most trying types of cases that our lawyers work on are those cases involving domestic violence. If you are a victim of domestic violence, we urge you to get help now. Our lawyers can help by representing you as you seek a domestic violence protective order, which is a civil restraining order that can protect you against physical violence and assault.
- Grandparents’ rights. Parents and their children are not the only parties who are impacted by divorce; grandparents may be adversely affected, too. For grandparents who have been denied visitation with their grandchild, working with a family law attorney may help. Unfortunately, grandparents have very few rights in our state, but a court may grant a grandparent access to their grandchild if the grandparent can prove that such access to visitation would be within the child’s best interests.
- When a child is born, the parental rights of the child’s mother are automatically established and cannot be revoked unless a court has good cause to do so. However, the same is not true for the child’s father. In order for the paternity of father to be established, the father must be married to the child’s mother at the time of the child’s birth, both parents must sign a voluntary acknowledgment of paternity form, or the court must establish paternity following DNA testing. If the father does not establish paternity, then the father will have no rights related to their child, which means that the father will not be able to seek custody of, visitation with, or legal decision-making power with regards to their child. Note that establishing paternity is important for mothers, too – if paternity has not been established, then the mother will have no grounds to seek child support payments, health coverage for the child on the father’s record, etc.
